Commercial Rent Arrears Recovery (CRAR)


Collected and enforced by laws as set out within the Commercial Lease Overdue debts Recuperation (CRAR) of the Tribunals, Courts & Authorization Act 2007.


All at ERE possess the necessary certification, training and full understanding of the Taking Control of Goods Regulations 2013 for Rent. We maintain high standards of service in dealing with any amount of commercial rent owed. All our staff act in a manor that is sensitive, professional and discreet to each case to allow a landlord/ tenant relationship to continue after instruction.

The latest Act dated 2007 came into force in 2014, this is when new regulations were implemented across the whole of the enforcement industry. On the 6th April 2014, the Common Law remedy or distraint or distress for rent was abolished. It was replaced by CRAR (Commercial Rent Arrears Recovery).

No need to go to court! All our enforcement agents have the expertise and knowledge of this regime. Under section 72 schedule 12 (taking control of goods) a commercial landlord will be able to recover rent payable under the lease of the tenant.


How is Commercial Rent Arrears Recovered?

Commercial Rent Recovery Process:


Discretion
Our team act quickly and discreetly, remaining professional throughout the process. We always ensure the protocols & processes are followed ensuring a calm & compliant result for both client and tenant. This sets out a way for continued landlord & tenant relationships following the collection of rent arrears.
Compliance and Enforcement
The process starts with the compliance period. Formal notice is sent to the tenant demanding the arrears be paid. Should tenants comply & make payment in full, then only a small charge will be added by ERE.

If arrears are not paid we move to Enforcement stages. This is where our enforcement agents visit the premises to collect the balance, arrange a payment agreement, or take control of goods.

Should tenants still not comply, the case will then move straight to the Removal & Sale Stage whereby agents are able to remove goods and sell them to cover the rent arrears and costs.
Sale Stage
Where compliance is not given, or payment set-ups are not followed through on, a 48 hour "Notice of Intention to re-enter the premises is given.

Tenants are then required to make full payment within the 48 hours or removal action can take place. You may then also be able to recover costs for any expenses required, for example, locksmiths, storage, and auctioneers.
