Protective Controlled Goods Agreement


Tenants with cashflow problems?


If another enforcement company decide to Take Control of Goods to get the money owed to them, then your payments my be compromised, unless you put a Protective Controlled Goods Agreement in place to protect you.

Possible Problems

It is not of interest to other enforcement companies of landlord debts, they are only obligated to Take Control of Goods, ensuring their client recovers what they are owed. This is why it is important to have a PCGA (Protective Controlled Goods Arrangement) in place.

Executing The Solution
• Instruct ERE as quickly as possible so we can issue the compliance letter.
• ERE will negotiate with the tenant.
• ERE will enter into an agreed Protective Controlled Goods Agreement with the tenant.

When PCGA is in place, the landlord is shielded by the payment plan. Then when the landlord has the tenants goods the landlord and tenant are both shielded from any creditors that may proceed with enforcement action.

Functioning in the same way as a CRAR where a 7-day Notice of Enforcement is sent to the tenant. The notice informs the tenant the landlord is willing to offer a PCGA (Protective Controlled Goods Agreement) minimising the costs. On an agreed date, our enforcement agent will meet with the tenant, seize the goods and set up a payment agreement. A 48-hour warning notice would be sent to the tenant advising them to bring their arrears up to date if this is not done. The landlord has the protection of CRAR if the tenant does not provide payment. an agent will be sent out to recover the payment if the tenant does not provide it as the outstanding rent becomes due immediately. The enforcement officer can begin to remove goods to cover the debt as allowed by law.

• A lowered rate of charges allowing your tenant help with their business.
• Makes sure you are in control before agreeing to a lengthy payment plan.

If you do not act on time, you may be left without anything. We are able to issue a compliance letter as quickly as we receive instruction from you, enabling us to negotiate with your tenant on your behalf. We can engage the Protective Controlled Goods Agreement with your tenant, so you are shielded throughout the entire payment plan. And once you gain possession of your tenants’ goods, your tenant is also protected from other creditors.

Protection
The tenant will receive a 48-hour warning notice instructing them to pay their arrears if they do not do so on time. The landlord will be protected by the CRAR if no payment be provided. It will be proceeded with an agent visiting the tenant to recover the payment. If it is still not provided, the enforcement officer will be permitted to remove goods to cover the balance.

The arrangement also protects your tenant from other creditors, with a reduced rate of charges allowing their business to continue. It also gives protection to your tenant from other creditors, with a reduced rate of charges allowing their business to proceed as normal.
