Nationwide Traveller and Squatter Evictions


Private landlords have various choices when eradicating trespassers by going through Common Law. For example, going with the Court route of obtaining a possession order which can transferred to the High Court to receive a writ of possession enforced by High Court Enforcement Officer. “Using no more force than what is reasonably necessary” a Landlord can remove trespasser if they have peaceably entered onto private land, but firstly the landlord or landlord agent must ask them to leave. By using the Common law, it provides the private landlords with power over the situation and the possibility to get a court order.


A couple available processes

The two processes offered to clients are…

… If trespassers have breached your land, ERE requests that they leave before forceful removal is undertaken. This is done through a 24-hour notice. Otherwise, we can give the 2–4-hour self-help eviction notice and remain on the site to view the vacation of the land and removal of their properties.

…However, sometimes it is not possible for land to be cleared of squatters and illegal encampments in a 2–4-hour timeframe, so our Certified Enforcement Agents might ask to remain on your site for up to 12 hours so the task can be accomplished.

Costs vary depending on chosen processes from the two mentioned above.


Police Involvement
The police are informed when ERE Enforcement feel it is essential when serving the notice of eviction/physical eviction is taking place. The Department for communities and Local Government (February 2004) recommends police be present to reduce the risk of a breaching the peace. The police will also evaluate the situation and if conclude that the eviction is not appropriate at that time, then it should definitely be delayed until an agreed time. If a landlord chooses to ignore the police instruction, the eviction could lead to an injury, assault or damage to a person or property.

Avoiding Court Orders
Although it is possible to apply for a court order, you could be waiting up to 21 days as well as resulting in costs of up to £5,500. ERE acts as quickly as possible to clear your land of trespassers, with most departing once a notice is served to them. In this situation, your only cost is for the attendance as well as the notice serving. However, enforcement costs will be higher if we need to stay on site for longer and have to involve use of removal vehicles. Still, there is a lower expense when a Court Order is obtained as Common Law evictions are much more affordable and less time-consuming.

Outside of the above a court order is possible but can take up to 21 days and may be quite expensive, typically between £4,000 – £5,500.00 due to solicitor, court and enforcement costs.
